Two years sounds generous, but building a case that actually holds up, including gathering medical records, securing witness statements, working through liability disputes, takes time. Waiting until the final months is a problem most injured people do not recognize until they’re in it.
Modified Comparative Fault. Illinois follows a modified comparative negligence system under 735 ILCS 5/2-1116. If you share some fault for the crash, your recovery is reduced by your percentage. If you are found 51% or more at fault, you are barred from recovering anything. Insurance adjusters use this rule to their advantage at every opportunity.
