Bus Accident Lawyer Addison, IL
If you were injured in a bus accident in Addison, IL, the path to compensation is more complicated than a standard car accident claim. Bus accidents involve institutional defendants, including transit authorities, school districts, private charter companies, and commercial carriers, each operating under different liability rules, different insurance structures, and in some cases, dramatically different filing deadlines.
Our Addison, IL bus accident lawyer handles bus and commercial transit vehicle accident claims throughout DuPage County and the greater Chicago area. Bus operators owe a heightened duty of care to the passengers they carry as common carriers under Illinois law, and when they fail that duty, injured victims have the right to pursue full compensation. The rules governing how and when to file that claim depend on who you’re filing against. Getting that right from day one is what we do. Why Choose Larson Law Injury Lawyers for Bus Accident Claims in Addison, IL?
Built for the Complexity These Cases Require
Bus accident cases sit at the intersection of personal injury law and institutional litigation. Suing a transit authority is not the same as suing an individual driver. Filing against a school district involves different procedural rules than filing against a private charter company. And when federal commercial carrier regulations apply, the evidentiary demands are different still. You need a strong legal team on your side, and you’ll get it with our firm.
John Larson founded Larson Law Injury Lawyers with offices in La Grange and Chicago. He is a member of the American Bar Association, the Chicago Bar Association, the DuPage County Bar Association (the county where Addison is located) and the Illinois State Bar Association. He earned his J.D. at The John Marshall Law School in Chicago and is recognized as one of America’s Top 100 Personal Injury Attorneys, a by-invitation distinction covering fewer than half a percent of active U.S. attorneys in high-value personal injury, catastrophic injury, wrongful death, and medical malpractice.
Before founding Larson Law, John spent over 35 years running businesses. He understands how large institutions manage liability exposure, where they apply defensive resources, and how to build a case that holds up against well-funded institutional defendants. Bus cases frequently involve exactly that: a transit authority, school board, or commercial carrier with its own legal team already working to contain the claim.
As a personal injury lawyer in Addison, IL, we represent clients throughout DuPage County, LaGrange, and Chicago in serious bus and commercial vehicle cases. We are prepared to take these claims to trial.
Results That Reflect the Work
Our clients have recovered millions of dollars in personal injury and civil litigation matters. Institutional defendants and their insurers do not settle these cases for what they are worth without pressure. We apply that pressure.
No Fees Unless We Win
All bus accident cases at Larson Law Injury Lawyers are handled on contingency. Nothing is owed unless we recover compensation on your behalf, regardless of how long the case takes or how it resolves.
⭐⭐⭐⭐⭐ I had a case, as the Plaintiff, and I hired an attorney that came highly recommended by friends and neighbors.
Things were going okay but I didn’t feel like my attorney was listening to me and wanting to fight as hard as I wanted to. So I hired John on as well to help with the case. Solely because of John, I got everything and more that I was asking for in my case. My first attorney even said, “I’m shocked they took our counter-offer”. I think some attorneys just want to give up or not fight hard. Just “finish up a case”. But John loves to win and his win, was my win! If you are reading this-your search for a winning attorney is OVER. I still tell people about this case. I knew what I wanted (even if it sounded extreme) and John got it done.

Types of Bus Accident Cases We Handle in Addison
Bus crashes in and around Addison involve very different defendants and legal frameworks depending on the type of bus. These are the cases we handle:
- Public transit bus accidents. CTA and Pace buses serve the greater Chicago area, including DuPage County. When a public transit bus injures a passenger or strikes another vehicle, the applicable defendant is a government entity. This triggers specific notice requirements and a shortened filing deadline that does not apply in standard personal injury cases. Missing these deadlines forfeits the claim entirely, regardless of how clear the negligence is. Proving fault and documenting the full injury must begin immediately after a public transit crash.
- School bus accidents. A school bus crash involving a child, another vehicle’s occupants, or a pedestrian may create liability against the school district, the bus company under contract, the driver, or all three. School districts operate under Illinois government immunity rules similar to transit authorities, and the procedural requirements for filing against them differ from standard personal injury claims. These cases require careful identification of all liable parties before any action is taken.
- Private charter and tour bus accidents. Charter buses, party buses, and tour operators are private companies. These claims do not involve government immunity complications, but they do carry commercial carrier obligations. Driver fatigue and distraction are documented causes of commercial vehicle crashes, and charter bus operators are subject to federal hours-of-service regulations that create a clear basis for negligence when violated.
- Commercial intercity bus accidents. Interstate commercial buses, such as Greyhound, FlixBus, and similar carriers, are regulated by the FMCSA and subject to federal safety standards beyond standard Illinois personal injury law. Injuries in high-impact oversized vehicle crashes can be severe and produce long-term consequences. Multiple passengers may be injured in a single crash, each with their own claim, requiring coordinated investigation and separate case development.
- Pedestrian struck by a bus. Pedestrians struck by any type of bus have the same legal rights as any injury victim, with the added layer of the bus operator’s common carrier duty. The risk to pedestrians from large commercial and transit vehicles is real and documented. When a bus driver’s failure to yield, distraction, or recklessness causes a pedestrian crash, the carrier is accountable.
- Wrongful death from a bus crash. When a bus crash takes a life, surviving family members may bring a wrongful death claim alongside any survival action. In cases involving a government-operated bus, the wrongful death claim is also subject to the shorter deadline and notice rules that apply to other government entity claims. Coordinating these claims from the start is essential.
Illinois Legal Requirements for Bus Accident Claims
Bus accident claims in Illinois involve layered procedural rules that vary significantly based on who operated the bus. Getting these requirements right is not optional.
Common Carrier Duty of Care. Under Illinois law, bus operators functioning as common carriers, companies that hold themselves out to the public as transportation providers, owe passengers a heightened standard of care. This standard is higher than ordinary negligence. A bus driver who is distracted, fatigued, or operating a poorly maintained vehicle while carrying passengers has failed a duty that extends beyond what a private motorist owes. This elevated standard applies to both public transit and private commercial carriers.
Government Entity Claims — Shorter Deadlines. When the bus is operated by a public transit authority like CTA or Pace, claims are governed by the Illinois Local Governmental and Governmental Employees Tort Immunity Act. Under 735 ILCS 5/8-101, personal injury actions against local public entities must be filed within one year of the date of injury — half the time available for claims against private defendants. This deadline is firm, and courts do not routinely extend it for good intentions or delayed discovery. If you were injured on a CTA or Pace bus, you need legal counsel immediately.
Private Bus and Motor Carrier Claims. Claims against private bus companies, charter operators, and commercial carriers follow the standard two-year SOL under 735 ILCS 5/13-202. Federal commercial bus operators are additionally subject to FMCSA bus safety regulations, which impose specific standards on driver qualifications, hours of service, vehicle maintenance, and inspection. Violations of these standards can establish the basis for a negligence claim directly.
Comparative Fault. Illinois modified comparative negligence under 735 ILCS 5/2-1116 applies to bus accident claims the same as any personal injury case. Defendants will look for any basis to assign partial fault to injured passengers or third-party victims. Social media posts made after a crash are among the first things defense counsel examines for these purposes.
What Damages Are Recoverable in Addison, IL Bus Accident Cases?
A successful bus accident claim in Illinois allows recovery across three categories.
Economic Damages. Emergency care, hospitalization, surgery, rehabilitation, and future medical costs tied directly to the crash. Lost wages for time missed from work during recovery. If the injuries have permanently reduced your earning capacity, future lost income is part of the claim. Property damage is a separate, recoverable loss.
Non-Economic Damages. Physical pain from bus accident injuries, the emotional distress of a serious crash and its aftermath, disruption to daily life, and harm to personal relationships are all compensable under Illinois law. Illinois imposes no cap on non-economic damages in personal injury cases. That matters when injuries are severe, as they frequently are in commercial vehicle crashes.
Punitive Damages. Available when a defendant’s conduct was willful, wanton, or fraudulent rather than merely negligent. A charter bus operator who knowingly allowed a fatigued driver to continue driving past legal limits, or a carrier that falsified inspection records on a vehicle with known brake defects, may face punitive exposure. Reliable testimony establishing the nature of that misconduct is essential in making the case for these additional damages, and the factual investigation must begin early.
